Registered Dispensing Opticians
Registered Dispensing Opticians are individuals, small businesses, corporations, and firms engaged in the business of filling prescriptions written by licensed physicians and surgeons for prescription lenses.
The Registered Dispensing Optician certificate authorizes the applicant and its employees to engage in the business of providing the fitting and adjusting of spectacle and contact lenses. Employees must obtain Spectacle Lens Dispenser and Contact Lens Dispenser registrations.
California Business and Professions Code Section 2540 states that no person other than a physician and surgeon or optometrist may measure the powers or range of human vision or determine the accommodative and refractive status of the human eye or the scope of its functions in general or prescribe ophthalmic devices.
A prescription ophthalmic device includes any spectacle or contact lens ordered by a physician and surgeon or optometrist, that alters or changes the visual powers of the human eye.
A dispensing optician includes a spectacle lens dispenser, a contact lens dispenser, a nonresident ophthalmic lens dispenser, or a registered dispensing ophthalmic business.
Spectacle Lens Dispensers
California Business and Professions Code Section 2559.1 provides an individual shall not fit and adjust spectacle lenses unless the individual is a duly registered spectacle lens dispenser or the individual is an unregistered individual who performs the fitting and adjusting under the direct responsibility and supervision of a duly registered spectacle lens dispenser whose certificate of registration is then conspicuously and prominently displayed on the premises.
Contact Lens Dispensers
A Contact Lens Dispenser must be a duly registered contact lens dispenser or an unregistered individual who performs the fitting and adjusting under the direct responsibility and supervision of a duly registered contact lens dispenser who is then physically present on the registered premises. In no event may a registered contact lens dispenser supervise more than three unregistered individuals.
Nonresident Ophthalmic Lens Dispensers
A person located outside California shall not ship, mail, furnish, or deliver in any manner, ophthalmic lenses at retail to a patient at a California address unless the person is registered with
the California State Board of Optometry.
This certificate authorizes a business located outside of California to ship, mail, or deliver in any manner, replacement contact lenses at retail, pursuant to a valid prescription, to a patient at a California address.
With regard to Nonresident Ophthalmic Lens Dispensers, only spectacle lenses and replacement contact lenses provided pursuant to a valid prescription may be shipped, mailed, furnished, or delivered directly to a patient.
Registered Dispensing Ophthalmic Businesses
Individuals, corporations, and firms engaged in the business of filling prescriptions of physicians and surgeons licensed by the Medical Board of California or the Osteopathic Medical Board of California, or optometrists licensed by the California State Board of Optometry for prescription lenses and kindred products are known as dispensing ophthalmic businesses and may not engage in that business unless registered with the California State Board of Optometry.
