In California a Registered Nurse can administer IV Hydration Infusion Therapy prescribed by a physician. What is less clear is whether IV drip hydration can be administered in a person’s home rather than in a medical facility such as a med spa in a building.  However, as one can readily see, most IV Hydration Infusion Therapy businesses in California are mobile, providing services in the homes of people who call for treatment.

Registered nurses in California today are being offered courses in learning the protocols required for the administration of IV infusion therapy in a person’s home and to what degree supervision is required of the medical director in this type of mobile medical spa and as a California mobile IV hydration lawyer we’ve seen many of the documents being provided to registered nurses who take such courses.

However, it is clear that before a person can be provided with IV hydration infusion therapy, the patient must still be evaluated to determine if he or she is a good candidate for the treatment and a good-faith exam or initial evaluation must be conducted prior to rendering any such treatment, particularly if prescriptive drugs are involved.

The California statute which allows a registered nurse to administer drugs or devices upon an order prescribed by any of these medical professionals is contained in California Business and Professions Code Section 2725.1.

Whether IV therapy takes place in a medical spa or a mobile IV therapy setting, a medical director  who can be geographically available in Califonria is required for supervision.   However, it is in both the interest of the medical professionals involved and the patient that any IV hydration infusion therapy treatment to be administered is first prescribed by the medical director or NP after a good faith exam, and absolutely if prescription drugs or prescriptive devices are involved.

In any event, it is advisable that a good faith exam be conducted prior to each new patient’s first IV therapy and again if the treatment the patient will be receiving has changed since the initial good faith exam was conducted.

There is also support for whether a PA can administer an IV to a patient in a mobile or bricks and mortar setting under California Law.

Code of Regulations  16 CCR § 1399.541 which states a PA can “Administer or provide medication to a patient, or issue or transmit drug orders orally or in writing in accordance with the provisions of subdivisions (a)-(f), inclusive, of Section 3502.1 of the Code.”
And California Business and Professions Code Section 3502.1(c)(1) states, ” A physician assistant shall not administer or provide a drug or issue a drug order for a drug other than for a drug listed in the formulary without advance approval from a supervising physician and surgeon for the particular patient.”  This would seem to say a PA can administer an IV if it is listed in the formulary with approval from the PA’s medical director.

It is, however, in this gray area that mobile IV hydration infusion therapy businesses are now being formed to operate all across California without any specific guidance from the California Medical Board that IV therapy can be provided in people’s homes. IV treatments are commonly provided to treat colds, migraines, the flu, hangovers, food poisoning, low energy, fatigue, jet lag, and chronic illnesses. The cost of an IV drip hydration therapy in a person’s home can range from less than $200 to more than $500.

A drip hydration infusion therapy administered into a person’s body may consist of a base bag of pure saline solution commonly given in hospitals to one with vitamins and other ingredients.

Because the rendering of fluids and vitamins is the practice of medicine, lay persons may not obtain any profits from the Professional Medical Corporation.
