HOW MUCH IS MY CASE WORTH?

The value of a case depends on many factors including, but not limited to, the severity of your injuries, the total of your medical bills, the type and amounts of treatment you received, your wage losses, whether the injuries affected your marriage or ability to work around the house, and the prognosis for future medical bills, future wage losses and future medical problems. Once we have been retained and have been able to evaluate your case with all of these factors having been determined, we will be better able to determine the value of your case.

HOW LONG WILL MY CASE TAKE?

The average time of treatment from a personal injury case is 6 to 9 months. If your injuries are less serious, treatment will likely finish sooner. If your injuries are severe, they may take a year or more of treatment, and sometimes may require a lifetime of treatment. Once your treatment has been completed and we have obtained all of your medical records and bills and one or more medical reports from your treating doctors, we put together what is referred to as a Asettlement demand@ package. That package is sent to the insurance company for the party at fault. We have to give the insurance company 40 days to respond, and there is usually some weeks of negotiation before we have a settlement offer that may be acceptable to a client. The short answer to this question is that if the case is one that settles, it will likely still take at least 2 months after your treatment has been completed for your case to settle. If the case goes into litigation, it will take longer.

WHO WILL I BE DEALING WITH?

Sebastian Gibson will be your attorney, although you may also on occasion speak to his secretary. You should not talk to anyone else about your case without first checking with attorney Sebastian Gibson if it is alright to do so. That especially includes any insurance companies, any investigators, or anyone else calling you out of the blue. If in doubt, check with our offices before talking to them. Simply take their name and number and then call us.

WHAT IS THE MOST IMPORTANT THING I SHOULD DO?

Focus on getting well. Follow your doctor's advice, obtain the treatment your doctor recommends and call us anytime you change doctors, start any new type of treatment or finish part of your treatment. We will obtain your medical records and bills and have them available should you wish to look at them.

SHOULD I PAY FOR ANYTHING?

We will advance the costs of obtaining medical records and bills, police reports and other litigation costs. Use your medical insurance first for payment of your medical bills. Any bills that your medical insurance doesn't pay, should be sent to your car insurance for payment if you have medical payments coverage on your insurance policy. If your physicians require a co-pay payment, go ahead an pay the co-pay, but provide us with receipts. You will have questions with regard to paying medical bills and some doctors may be willing to accept liens if you have no insurance. If you have questions in this regard during your case, call us.
